These terms apply to templates bought from this site. The shop is not open for orders yet, and a solicitor is reviewing this page before it opens, so some wording will change. It is published now so you can read it before you ever have to rely on it.
A starting point, not advice
Donga Docs templates are general documents written for common work. They are not written for your business, your site, your equipment or your workers, and they are not legal, WHS or professional advice.
Your responsibility
As a person conducting a business or undertaking (PCBU), you are responsible for health and safety in your business. Before you use any template, you must:
- fill it in and adapt it to your actual work, site, plant and people
- check it against the law, codes of practice and standards that apply in your state or territory. These differ between states and change over time.
- consult your workers, and train and supervise them
- review and update it when things change
Buying or using a template doesn't guarantee that you comply with any law, or that you'll pass an audit, a prequalification or a tender assessment.
Accuracy
We work to keep the templates accurate and up to date when we publish them. Laws, codes and standards change, and we don't promise that every reference is current when you use it.
Our liability
Nothing in these terms takes away any rights you have under the Australian Consumer Law that can't be excluded. Apart from those rights, and as far as the law allows:
- we are not liable for any loss, damage, injury, fine or claim that comes from using a template, from how you changed it, or from not adapting it to your work
- we are not liable for indirect or consequential loss, such as lost profit, lost contracts or delays
- where our liability can be limited, it is limited to supplying the template again or refunding what you paid for it
Indemnity
You agree to indemnify Donga Docs against any claim, loss or cost, including reasonable legal costs, that a third party brings against us because of how you used, changed or failed to adapt a template.
